Shades of Grey

Abstract

This note analyses the case of Seldon at the Supreme Court in the UK. The question was whether it is possible for an employer to justify adopting a compulsory retirement age despite the fact that the legislation allowing compulsory retirement generally had been abolished in the UK. The Court relied upon the judgements of the European Court of Justice, but the basis for those judgments are also questioned here.
