Resumen
La liberalización de servicios en el mercado único europeo es uno de los vectores de avance económico más incisivos impulsados por la Unión Europea a través de la Directiva 2006/123/CE del Parlamento Europeo y del Consejo, de 12 de diciembre de 2006. En el caso español, esto ha obligado a la adaptación de nuestro ordenamiento jurídico para responder a la realidad de un mercado de servicios profesionales cada vez más conectado y competitivo. Los problemas que se plantean en cuanto al posicionamiento de los Colegios Profesionales frente a esta nueva realidad, son numerosos. La propia jurisprudencia del TJUE ha venido a establecer algunos criterios para hacer compatibles los distintos sistemas imperantes en los distintos Estados miembros al objeto de hacer posible un verdadero mercado único de servicios profesionales, ampliando, de este modo, el ámbito objetivo de aplicación de la libertad de establecimiento y de la libre prestación de servicios. En el caso de las actividades investidas del carácter de autoridad pública, esto implica problemas adicionales.
The liberalisation of services in the single European market is one of the most incisive vectors of economic advancement driven by the European Union through Directive 2006/123/EC of the European Parliament and of the Council, of December 12, 2006. In the Spanish case, this has forced the adaptation of our legal system to respond to the reality of a market of professional services increasingly connected and competitive. The problems that arise regarding the positioning of the Professional Associations in the face of this new reality are numerous. The CJEU's own jurisprudence has come to establish some criteria to make compatible the different systems prevailing in the different Member States in order to make possible a true single market of professional services, thus expanding the objective scope of application of freedom of establishment and freedom to provide services. In the case of activities invested with the character of public authority, this implies additional problems.
