Resumen
La criticada reforma laboral instituida por la Ley 13.467 consagró la posibilidad de superposición de la negociación colectiva sobre las normas estatales y la hipótesis de superposición de la negociación individual sobre la negociación colectiva y sobre la ley como forma de solución de antinomias en materia de derecho del trabajo. El legislador quizo, con este cambio, enfatizar la autonomía de la voluntad de quienes ganan más de dos veces el beneficio máximo de la seguridad social. La estipulación inicial puede contrarrestar normas de orden público y normas negociadas colectivamente porque fue inserto un parráfo único al artículo 444. Las alteraciones del contrato de trabajo, por otro lado no lo pueden pues el artículo 468 no cambió en nada. Además, las reglas que resultan de la autonomia de la voluntad no se extienden a toda situación negociadora, sino sólo a aquellas hipótesis expresamente previstas en la legislación.
The criticized labor reform instituted by Law 13,467 enshrined the possibility of overlapping collective bargaining over state norms and the hypothesis of overlapping individual bargaining over collective bargaining and over the law as a way of solving antinomies in matters of labor and employment law. The legislator wanted, with this change, to emphasize the autonomy of the will of those who earn more than twice the maximum benefit of social security. The initial stipulation can counteract public order norms and collectively negotiated norms because it was inserted a single paragraph to article 444 of the brazilian Consolidation of Labor Laws - CLT. Alterations of the employment contract, on the other hand, cannot, because article 468 did not change at all. In addition, the rules that result from the autonomy of the will do not extend to any negotiating situation, but only to those hypotheses expressly provided for in the legislation (Art. 611-A of the brazilian Consolidation of Labor Laws – CLT).
