Resumen

El objeto del presente estudio es el Convenio de la OIT sobre la prevención de accidentes industriales mayores del año 1993, Convenio que hasta la fecha no ha sido ratificado por España, no obstante lo cual en nuestro marco normativo nacional y supranacional, hemos de señalar que si existe un importante marco legal en materia de prevención de accidentes industriales mayores, como después veremos. Los accidentes industriales mayores trascienden los límites de las empresas en los que acontecen y tienen una especial repercusión en el entorno en el que acontecen, ya sea por la gravedad de sus consecuencias, ya sea por el elevado número de víctimas, de heridos, de pérdidas materiales y, en fin, de los graves y en muchos casos irreparables daños al medio ambiente que ocasionan. Creemos necesario abordar la materia de una manera objetiva, pero sin olvidar la necesidad de adoptar un enfoque global y coherente, que nos permita alcanzar los objetivos de desarrollo sostenible (ODS), y en particular los relativos a combatir el cambio climático y a la defensa del medio ambiente. Los accidentes industriales mayores no son muy frecuentes, pero su impacto social y medioambiental sí que lo es, de modo que se hace necesaria la implementación de un conjunto de herramientas de carácter preventivo, informativo, formativo, de control y de sanción en la materia, con el objeto de eliminar el riesgo de acaecimiento de un accidente industrial mayor, o en su caso, de minimizar los efectos devastadores que para el entorno ocasionan.

Major industrial accidents transcend the boundaries of the companies in which they occur and have a special impact on the environment in which they occur, either because of the seriousness of their consequences, or because of the high number of victims, injuries, losses materials and, in short, the serious and in many cases irreparable damage to the environment they cause. We believe it is necessary to address the matter in an objective manner, but without forgetting the need to adopt a comprehensive and coherent approach, which allows us to achieve the objectives of sustainable development (SDGs), and in particular those related to combating climate change and defending environment. Major industrial accidents are not very frequent, but their social and environmental impact is, so that it is necessary to implement a set of tools of a preventive, informative, formative, control and sanction nature, in order to eliminate the risk of a major industrial accident, or, where appropriate, to minimize its devastating effects that the environment causes.
