Resumen
En los últimos años, se han cuestionado determinados tipos de cooperativas que aprovecharían las ventajas que les ofrece su especial marco normativo para defraudar las expectativas jurídicas y económicas de las personas que trabajan en ellas y del sistema de Seguridad Social. Es probable que los procedimientos administrativos al respecto no se ajusten a las exigencias de la legislación cooperativa y, sobre todo, han generado bastante inseguridad jurídica. En este contexto, este trabajo pretende aportar alguna reflexión de utilidad para la reforma normativa que se encuentra en marcha.
In the last years, certain types of cooperatives have been questioned as taking advantage of their special regulatory framework to defraud the legal and economic expectations of the people who work in them and of the Social Security system. It is likely that the administrative procedures in this respect are not in line with the requirements of cooperative legislation and, above all, have generated considerable legal uncertainty. In this context, this paper aims to provide some useful reflections for the regulatory reform that is currently underway.
