Resumen
La pandemia derivada de la expansión del virus SARS-CoV-2 ha supuesto un auténtico revulsivo en el desarrollo del teletrabajo o trabajo a distancia en España, que en ese momento contaba con un marco legal claramente insuficiente, puesto que su práctica hasta entonces ha sido ciertamente residual. A lo largo de estas líneas se pretende ahondar en la regulación española del teletrajo y su aplicación a trabajadores y trabajadoras por cuenta ajena antes, durante y después del confinamiento domiciliario, con el propósito de poner de relieve el régimen jurídico aplicable a las personas que durante esta pandemia han estado y/o están teletrabajando, así como analizar las consecuencias de ello, las fortalezas y debilidades del sistema y, en la medida de lo posible, hacer propuestas de lege ferenda.
The pandemic derived from the expansion of the SARS-CoV-2 virus has been a real trigger in the development of teleworking or remote work in Spain, which at that time had a clearly insufficient legal framework, since its practice until then has been certainly residual. Along these lines, the aim is to delve into the Spanish regulation of tele-translation and its application to employed workers before, during and after home confinement, in order to highlight the legal regime applicable to people that during this pandemic they have been and/or are teleworking, as well as analyzing the consequences of this, the strengths and weaknesses of the system and, as far as possible, making proposals de lege ferenda.
