Resumen
El sistema de la Seguridad Social se muestra, en términos generales, adecuado para lograr la finalidad que con él se pretende, paliar ciertas situaciones de necesidad. No obstante, es posible encontrar en él ciertas deficiencias o carencias normativas que lastran la plena protección de algunos colectivos. En este trabajo se indaga sobre algunos de estos déficits de protección social, señaladamente los que se detectan en materia de jubilación voluntaria anticipada, prestaciones familiares y en favor de familiares y prestación para el cuidado del menor afectado por cáncer u otra enfermedad grave. De igual forma, se dará cuenta del nuevo y reformado complemento para reducir la brecha de género en las pensiones, un mecanismo con el que se pretende – está por ver si lo logra – compensar los defectos de cotización que hubieran podido acontecer durante la vida laboral de los progenitores por el cuidado de hijos.
Generally speaking, the system of Social Security seems to be useful to achieve its purpose, alleviate certain situations of need. However, it is possible to find certain deficiencies and shortcomings of regulatory framework in it, that reduces the full protection of some groups. This work investigates some gaps in Social Security protection, in particular those detected regarding voluntary early retirement, family and family members benefits and benefits for the care of children with cancer or other serious illness. In addition, this work shall give details of the new and redesigned allowance to reduce the gender gap in the pensions, intended – still to be seen if successfully – as a mechanism which could compensate the deficiency in contributions in parents working life due to child care.
