La interacción entre el ordenamiento jurídico internacional y el interno suele generar bastantes problemas prácticos. Esto es así porque, normalmente, confluyen intereses que en ocasiones son contrapuestos. La comprensión de varios tipos de normas para resolver un mismo asunto no es, en definitiva, una tarea sencilla. En este comentario el A. tratará de despejar las dudas existentes a la hora de demandar por despido cuando los trabajadores prestan servicio en organizaciones o entidades públicas de ámbito internacional. Concretamente, si los tribunales españoles tienen competencia para resolver este tipo de litigios entre trabajadores y organismos internacionales cuando tienen su sede en nuestro territorio. En definitiva, se tratará de delimitar el alcance de la inmunidad de jurisdicción.
The interaction between the international legal order and the domestic legal order often generates quite a few practical problems. This is because, normally, converge interests that are sometimes opposed. Understanding various types of rules to resolve the same issue is ultimately not a simple task. In this commentary the A. will try to clear the existing doubts when suing to dismissal when workers serve in international public organizations or entities. Specifically, if the Spanish courts have jurisdiction to resolve this type of litigation between workers and international organizations when they have their headquarters in our territory. Ultimately, it will try to define the scope of immunity from jurisdiction.
