Hasta fechas muy recientes, el tiempo que las mujeres invirtieron en el Servicio Social Femenino (1937-1978) no computaba a efectos de alcanzar el periodo mínimo de cotización requerido para acceder a la jubilación anticipada o parcial, algo que, sin embargo, si se tuvo siempre en cuenta con el tiempo que los hombres prestaron en el servicio militar obligatorio o la prestación social sustitutoria. Esta diferencia de trato discriminatoria fue corregida por el Tribunal Supremo en 2020. La STS 115/2020 tuvo gran trascendencia práctica puesto que, llevó al Tribunal Superior de Justicia a reconocer este mismo derecho para el Régimen de Clases Pasivas y al legislador a modificar el régimen jurídico de la jubilación anticipada y parcial (arts. 207, 208 y 215 LGSS). Con esta aplicación de la perspectiva de género se elimina una de las numerosas discriminaciones históricas que han sufrido las mujeres en el ámbito laboral y de la Seguridad Social lo que contribuye a avanzar hacia una sociedad más justa e igualitaria.
Until very recently, the time that women invested in the Women’s Social Service (1937-1978) did not count towards reaching the minimum contribution period required to access early or partial retirement, something that, however, was always taken into account with the time that men served in mandatory military service or alternative social service. This discriminatory treatment was corrected by the Supreme Court in 2020. Ruling No. 115/2020 had great practical significance, as it led the Higher Court of Justice to recognize this same right for the Passive Classes Regime and the legislature to modify the legal regime of early and partial retirement (arts. 207, 208 and 215 of the General Law on Social Security). With this application of a gender perspective, one of the numerous historical discriminations that women have suffered in the workplace and in the Social Security system is eliminated, contributing to advancing towards a more just and egalitarian society.
