Resumen
La economía digital o uber economy ha transformado no solo la forma de prestar los servicios sino también los vínculos contractuales hasta entonces existentes entre quien presta un servicio y quien lo remunera. Las nuevas formas de trabajar están poniendo de manifiesto que ha surgido un nuevo tipo de trabajador, más independiente, más autónomo en su gestión si bien sometido a un empleador digital, el cual entre otros aspectos, controla y evalúa la calidad de sus servicios, y por tanto, la continuidad de su prestación por referencia a la información facilitada por un tercero: el usuario. Los caracteres que están delimitando estas nuevas formas de trabajar en la industria 4.0. están situando de nuevo a un amplio colectivo de trabajadores en una zona gris dentro del binomio trabajo por cuenta propia-trabajo por cuenta ajena. La finalidad de este trabajo será analizar los rasgos de estas nuevas prestaciones de servicios, su inclusión en el ámbito del trabajo por cuenta propia o por cuenta ajena, y en cualquiera de ambos supuestos, delimitar las bases de su marco contractual.
The digital economy or uber economy has transformed not only the way services are provided but also the contractual links that existed up to then between the person who provides a service and who pays for it. The new ways of working are showing that a new type of worker has emerged, more independent, more autonomous in its management, although subject to a digital employer, which, among other aspects, controls and evaluates the quality of its services, and therefore, the continuity of its provision by reference to the information provided by a third party: the user. The requeriments that are defining these new ways of working in the industry 4.0. are locating a large group of workers in a gray area. The purpose of this work will be to analyze the features of these new provision of services, their inclusion in the field of work for their own account or the salaried work, and in either case, define the bases of their contractual framework.
