Cuando el Fondo de Garantía Salarial comparece en el proceso social puede utilizar los medios de defensa que estime oportunos y ejercitar una serie de acciones. Recientemente se ha planteado la cuestión de si el Fondo de Garantía Salarial puede sustituir al titular del derecho a elegir entre la readmisión y la extinción del contrato cuanto el despido se declara improcedente. El objetivo de este estudio consiste, precisamente, en analizar la respuesta que los órganos judiciales han ido dando a este reciente y conflictivo asunto.
When the Wage Guarantee Fund appears in the social process, it may use the defense means it deems appropriate and exercise a series of actions. Recently, the question has arisen as to whether the Wage Guarantee Fund can substitute the right holder to choose between readmission and termination of the contract when dismissal is declared inadmissible. The objective of this study is precisely to analyse the response that judicial bodies have been giving to this recent and controversial issue.
