Resumen
Los algoritmos digitales corresponden a una realidad cada vez más asentada a nivel empresarial en el ordenamiento jurídico español. Esto nos hace reflexionar acerca de los posibles vacíos o lagunas existentes en aras de proteger jurídicamente a la persona trabajadora y, sobre todo, al papel de los representantes de los trabajadores en la materia, siendo necesario el fomento e impulso de la negociación colectiva para evitar la aparición de posibles situaciones discriminatorias en el entorno de trabajo ante la toma automatizada de decisiones empresariales. Por consiguiente, en el presente trabajo reflexionaremos sobre estos extremos, detectando así los nuevos retos existentes en el Derecho del Trabajo y el impulso que debiera tener la negociación colectiva y el dialogo social en la materia para garantizar los derechos más básicos de las personas trabajadoras.
Digital algorithms correspond to an increasingly established reality at the corporate level in the Spanish legal system. This makes us reflect on the possible loopholes in existing justice in order to legally protect the worker and, above all, the role of workers’ representatives in the matter, being necessary to promote and encourage collective bargaining to avoid the emergence of possible discriminatory situations in the work environment in the face of automated business decision-making. Consequently, in this paper we will reflect on these points, thus detecting the new challenges existing in Labour Law and the impulse that collective bargaining and social dialogue should have in this area in order to guarantee the most basic rights of workers.
