Resumen
Los riesgos psicosociales son pluriofensivos, latentes y potencialmente irreversibles. Justifican, por ello, la puesta en marcha de la actividad postventiva de los empleadores, la misma que jurídicamente se desprende del deber de prevención, aunque tradicionalmente no se le haya reconocido esta pertenencia. Las dos primeras características de los riesgos psicosociales les son naturales. Pero la última es accidental; y, por tanto, evitable. Solo aparece ante la negligencia de la prevención terciaria que, sobre el riesgo, en apariencia controlado y aun eliminado, debió haber desplegado la empresa. Si las consecuencias de esta omisión ocasionan el suicido del trabajador, jurídicamente se podrá declarar al empleador de responsable civil, pues si bien el fallecido pudo haber tenido condiciones médicas preexistentes, la conducta del empleador pudo haber actuado como un detonante de aquellas; es decir, pudo haber asumido una preponderancia determinante en la etiología de la conducta suicida.
The psychosocial risks are multiply offensive, latent and potentially irreversible. Therefore, they justify the implementation of the post-ventive activity of employers, the same that legally follows from the duty of prevention, although traditionally this belonging has not been recognized. The first two characteristics of psychosocial risks are natural to them. But the last one is accidental; and therefore avoidable. It only appears before the negligence of tertiary prevention that, on the risk, apparently controlled and even eliminated, the company should have deployed. If the consequences of this omission cause the worker to commit suicide, legally the employer may be declared liable, because although the deceased may have had pre-existing medical conditions, the employer’s conduct may have acted as a trigger for them; that is, it could have assumed a determining preponderance in the aetiology of suicidal behaviour.
