Abstract
The implementation of the social paradigm for the treatment of disability has been an international challenge that has required various regulatory changes. Adapted environments to the needs of people with disabilities has been consolidated as a premise of the aforementioned model, as a result of the Convention of Rights of Persons with Disabilities and Directive 2000/78/EC. In this scenario, this article discusses, from a regulatory approach, the implementation of the social model in Spain. Specifically, the aim of this contribution is to determine whether the legal implementation of the social model of treatment of disability, especially claimed by the CJEU through its judicial pronouncements, has been assumed in the Spanish legal system. Thus, art. 49 of the Spanish Constitution, Act No. 13/1982, Act No. 51/2003, Act No. 26/2011 and Royal Legislative Decree No. 1/2013 will be examined.
