Teletrabajo internacional y legislación de Seguridad Social aplicable: estado de la cuestión y perspectivas en los Reglamentos de coordinación de la UE

Resumen

El teletrabajo internacional plantea dudas sobre la legislación nacional aplicable de Seguridad Social, pues no existe una norma de conflicto ad hoc y la regla general, la lex loci laboris, queda distorsionada con el trabajo virtual. El artículo explora las distintas opciones en el marco normativo vigente respecto del teletrabajo internacional puro, híbrido o realizado por voluntad del trabajador durante un cierto período de tiempo (teleworkation o south working), aludiéndose también al teletrabajo internacional pandémico vinculado al Covid-19. Entre las soluciones futuras, la A. aboga por una reinterpretación actualizada de la lex loci laboris que conduciría a aplicar la ley del lugar donde se ubica la empresa y no la del lugar donde el teletrabajador teclea su portátil. Conexión que debería ser sometida a ciertas cautelas para evitar el dumping social, exigiendo a la empresa la realización de una actividad sustancial en el Estado de establecimiento.

 

International telework raises questions about the applicable national social security legislation, as there is no ad hoc conflict rule and the general rule, the lex loci laboris, is distorted regarding virtual work. The article explores the different options in the current regulatory framework for international teleworking full-time, hybrid or in the interest of the employee (teleworkation or south working), also referring to pandemic international telework due to Covid-19. Among future solutions, the A. pleads for an updated reinterpretation of the lex loci laboris which would lead to the application of the law of the place where the company is located and not that of the place where the teleworkers type in their laptop. This interpretation should be subject to certain requirements to prevent possible drawbacks linked with social dumping, among others, the company should carry out substantial activity in the Member State of establishment.
