Resumen
El presente artículo centra su interés en el análisis de la nueva configuración de los contrataros formativos en España que tiene lugar a partir de la última reforma introducida mediante el RD-Ley 32/2021. Esta nueva regulación modifica la anterior incorporando un contrato formativo bajo dos modalidades: el contrato de formación en alternancia y el contrato formativo para la obtención de la práctica profesional. Sin duda, y en atención a los precedentes históricos, el elevado porcentaje de paro juvenil junto al necesario ajuste entre la formación y las necesidades reales del mercado de trabajo han sido los factores determinantes que han movido al gobierno de coalición para afrontar la reforma. Ahora bien, nos planteamos si dicha reforma ofrecerá la cobertura necesaria y, especialmente, las respuestas eficaces que se demandan en la actualidad. Finalmente, se aborda el estudio comparado de los aspectos esenciales en esta materia con la legislación italiana.
This article focuses on the analysis of the new configuration of training contracts in Spain that has taken place since the latest reform introduced by Royal Decree-Law No. 32/2021. This new regulation modifies the previous one by incorporating a training contract under two modalities: the alternating training contract and the training contract for obtaining professional practice. Undoubtedly, and in view of historical precedents, the high percentage of youth unemployment together with the necessary adjustment between training and the real needs of the labour market have been the determining factors that have moved to the coalition government to undertake the reform. However, we consider whether this reform will offer the necessary coverage and, especially, the effective responses that are currently demanded. Finally, a comparative study of the essential aspects in this area with the Italian legislation is addressed.
